- WE ARE NOT a licensed energy broker
- WE ARE NOT a utility company
- WE DO NOT sell or supply electricity
We are a marketing platform that connects consumers with third-party service providers who offer electricity-related services. We facilitate referrals and collect marketing fees from our partners.
Our role is limited to:
- Providing rate comparison information from third-party sources
- Referring you to third-party service providers (Enroll Power, PowerKiosk)
- Facilitating connections between you and energy service providers
- Collecting referral fees from our partners when you enroll
3. Information Sharing and Third-Party Consent
Consent to Information Transmission
By using our Service or submitting information through our website, you explicitly consent to us transmitting your personal information to third-party service providers to fulfill your service requests.
This includes sharing your information with:
- Enroll Power - Our primary enrollment partner
- PowerKiosk - Our technology platform provider
- Energy Suppliers - Companies that will provide your electricity
- Utility Companies - For account verification and service changes
- Other service partners - As necessary to fulfill your requests
What information we share: When you use our Service, we may transmit your name, address, email, phone number, utility account information, usage data, and any other information you provide to our third-party partners.

4. Third-Party Terms and Conditions
You Will Be Subject to Third-Party Terms
When you proceed with enrollment or use services through our partners, you will be subject to their separate terms and conditions, privacy policies, and agreements.
ElectricRates.org's Terms of Service govern only your use of our website and referral services. Your relationship with third-party providers is governed by their terms, not ours.

Important: We are not responsible for and do not control the terms, policies, or practices of third-party providers. We encourage you to carefully review all third-party terms before proceeding with enrollment.
5. Service Description
ElectricRates.org provides marketing and referral services to connect consumers with energy-related services in deregulated electricity markets. Through our website, we:
- Display electricity rate information from third-party sources (PowerKiosk)
- Facilitate referrals to Enroll Power for automated rate monitoring and supplier switching services
- Help you compare available electricity supply options
- Connect you with energy suppliers through our partners
Enroll Power's "Smart Enroll" Service: When you enroll through our platform, you may be enrolled in Enroll Power's automated electricity rate monitoring and supplier switching service. This service is provided by Enroll Power, not by ElectricRates.org.
ElectricRates.org receives referral fees and commissions from our partners when you enroll in services. These fees may influence which offers are displayed to you.
6. No Guarantees of Savings or Outcomes

WE DO NOT GUARANTEE THAT YOU WILL SAVE MONEY OR ACHIEVE ANY PARTICULAR OUTCOME BY USING OUR SERVICE.
- Electricity rates are subject to market fluctuations and can change at any time
- Past performance or estimated savings do not guarantee future results
- While rates may be competitive at enrollment, subsequent rate changes may result in you paying more than utility default rates
- We make no representations about the financial benefits you may or may not receive

- No warranty of accuracy: Rate information displayed is provided by third parties and may not be accurate or up-to-date
- No guarantee of service: We do not guarantee continuous availability of competitive rates or enrollment opportunities
- No guarantee of supplier performance: We are not responsible for supplier service quality, billing issues, or contract fulfillment
- Market conditions vary: Results may vary based on location, usage patterns, market conditions, and supplier availability
All rate comparisons, savings estimates, and projections are for informational purposes only and should not be relied upon as guaranteed outcomes.
7. Letter of Authorization (LOA)
If you proceed with enrollment through our partners (such as Enroll Power), you may be providing a Letter of Authorization that allows them to act on your behalf. This authorization is between you and the third-party provider, not ElectricRates.org.
A typical Letter of Authorization may allow the third party to:
- Act as your authorized agent for electricity supply matters
- Access your utility account information
- Enroll you with energy suppliers
- Switch suppliers on your behalf based on market conditions
- Receive commissions from energy suppliers
Important: Any such authorization is governed by the third party's terms, not ours. You can typically revoke this authorization by contacting the third party directly according to their cancellation procedures.
8. Energy Supplier Contracts
When you enroll with an energy supplier through our partners, you are entering into a direct contract with that supplier. ElectricRates.org is not a party to that contract.
Energy supplier contracts are separate agreements that may include:
- Fixed or variable electricity rates
- Contract term lengths (e.g., 6 months, 12 months, 24 months)
- Early termination fees or cancellation penalties
- Auto-renewal provisions
- Monthly service fees or other charges
- Supplier-specific terms and conditions
Important: You are responsible for reviewing and understanding all supplier contract terms before enrollment. We are not responsible for supplier contract terms, performance, billing, or disputes.
9. Cancellation and Account Management
Canceling with ElectricRates.org: Since we are a marketing and referral service, there is no ongoing service to cancel with us. Once you are referred to our partners, your relationship is with them.
Canceling with Service Providers: To cancel services or authorizations provided by our partners (such as Enroll Power's Smart Enroll service), you must contact them directly:
- Review the partner's cancellation policy and procedures
- Contact the partner directly to revoke authorization
- Follow their specific cancellation requirements
Canceling Energy Supplier Contracts: To cancel an active electricity supply contract, you must contact the energy supplier directly. Supplier contracts may have early termination fees and specific cancellation procedures.
Note: Canceling authorization with our partners does not automatically cancel existing supplier contracts. Those are separate agreements that require separate cancellation.
10. Referral Fees and Compensation
Our business model: ElectricRates.org operates as a marketing and referral platform. Our service is free to consumers. We generate revenue through:
- Referral fees: We receive compensation from our partners (Enroll Power, PowerKiosk) when we refer customers to them
- Marketing fees: Energy suppliers and service providers pay us marketing fees for customer referrals
- Commissions: We may receive ongoing commissions based on customer enrollments and activity
Disclosure: These financial relationships may influence which offers, rates, or suppliers are displayed or recommended to you. We strive to provide accurate comparisons, but our compensation structure may affect the presentation of available options.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Any guarantee of savings on electricity costs
- Uninterrupted or error-free website operation
- Accuracy of rate information or comparisons
- Availability of specific rates or offers
- Performance of third-party service providers
- Quality or reliability of energy suppliers
- Specific results or outcomes
As a marketing and referral service, we do not control or warrant the services provided by our partners or the energy suppliers they may connect you with.
12. Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELECTRICRATES.ORG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any electricity costs, whether higher or lower than expected
- Energy supplier contract terms, performance, or billing issues
- Third-party service provider actions or omissions
- Utility service interruptions or delivery issues
- Loss of savings or financial benefits
- Inaccurate rate information provided by third parties
- Indirect, incidental, consequential, special, or punitive damages
- Loss of profits, revenue, data, or business opportunities
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO $100 USD, OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER). SINCE OUR SERVICE IS FREE, THIS MEANS OUR MAXIMUM LIABILITY IS $100.
13. Indemnification
You agree to indemnify, defend, and hold harmless ElectricRates.org, its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:
- Your use of our Service
- Your breach of these Terms of Service
- Your violation of any applicable laws or regulations
- Disputes with energy suppliers or service providers
- Inaccurate or incomplete information you provide
- Your relationship with third-party service providers or energy suppliers
14. Governing Law and Dispute Resolution
Governing Law: These Terms of Service are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.
Arbitration: Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You may pursue claims in small claims court if your claims qualify.
Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions, class arbitrations, or representative actions.
Note: These dispute resolution provisions apply only to disputes with ElectricRates.org. Disputes with our partners, energy suppliers, or other third parties are governed by their respective terms and conditions.
15. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes by:
- Posting the updated Terms on our website with a new "Last Updated" date
- Sending email notification to registered users (if applicable)
- Displaying a prominent notice on our website
Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
16. Severability and Entire Agreement
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and ElectricRates.org regarding your use of the Service.
